Name released from Sunday fatality accident

An Emporia man is dead following a fatality accident on Interstate 35 early Sunday morning, according to information released Monday by the Emporia Police Department.

Jose A. Montes, 21, of Emporia has been identified as the victim of the incident, which is still under investigation by the Emporia Police Department.

Emporia Police Captain David DeVries said Monday that at about 2 a.m. Sunday, a semi-truck and trailer driven by Dewaine Jackson, 47, of Amarillo, Texas, was northbound on Interstate 35 approaching the Burlingame exit to Emporia, about mile marker 131. A pedestrian, identified as Jose A. Montes, 21, of Emporia, was in the roadway on I-35. The truck was reported to have attempted to avoid Montes but struck him. He was deceased at the scene.

“It is unknown at this time the exact reason the Mr. Montes was in the roadway,” DeVries said. “An investigation into this is ongoing.”
